RIM 'sues' Motorola over hiring blocks
RIM, according to the report, says an agreement between the companies "not to solicit each other's employees" ran out in August, but suggests that Motorola is still blocking its sackees from joining RIM. This could all be a bit tit-for-tat, though - Moto sued RIM over a similar issue a few months ago.
I'd love to get hold of RIM and Moto to find out more about this, but given the time of year I don't think I'd have much luck. One to keep an eye on, though.

Surely, non-solicitation clauses can only apply to staff still under contract with an employer. If Moto (or RIM) have let the staff go, then they are free to join any company that'll hire them.
However, if the staff have been put on "garden leave" by an employer then they are effectively still under contract so any non-solicitation rules could still apply.
